Distance Sales Agreement

By accepting this agreement, the BUYER acknowledges in advance and undertakes that if they approve the order subject to the contract, they will be obliged to pay the price of the order and any additional fees such as shipping costs, taxes, etc., and that they have been informed in this regard.

2. DEFINITIONS

In the application and interpretation of this Agreement, the terms written below shall refer to the written explanations opposite them.

  • MINISTER: The Minister of Customs and Trade,
  • MINISTRY: The Ministry of Customs and Trade,
  • LAW: Law No. 6502 on Consumer Protection,
  • REGULATION: Distance Sales Contracts Regulation,
  • SERVICE: Any consumer transaction other than providing goods, which is performed or promised to be performed for a fee or benefit,
  • SELLER: The company that offers goods to the consumer within its commercial or professional activities, or acts on behalf or account of the provider of goods,
  • BUYER: A natural or legal person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes,
  • SITE: The internet site belonging to the SELLER,
  • ORDERER: A natural or legal person who requests a good or service through the SELLER's internet site,
  • PARTIES: The SELLER and the BUYER,
  • AGREEMENT: This agreement concluded between the SELLER and the BUYER,
  • GOODS: Movable goods subject to trade, and intangible goods such as software, audio, video, etc., prepared for use in electronic environment,

3. SUBJECT

This Agreement regulates the rights and obligations of the parties in accordance with the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Sales Contracts, concerning the sale and delivery of the product whose qualities and sales price are specified below, which the BUYER has ordered electronically through the SELLER's website.

The prices listed and advertised on the site are sales prices. The advertised prices and promises are valid until updated and changed. Prices advertised for a certain period are valid until the end of the specified period.

7. CONTRACTUAL PRODUCT/PRODUCTS INFORMATION

1. The main characteristics (type, quantity, brand/model, color, number) of the goods/products/services are published on the SELLER's website. If the seller has organized a campaign, you can examine the main characteristics of the relevant product during the campaign period. Valid until the campaign date.

7.2. Prices

The prices listed and advertised on the site are sales prices. The advertised prices and promises are valid until updated and changed. Prices advertised for a certain period are valid until the end of the specified period.

7.3. Taxes and Payments

The sales price of the goods or services subject to the contract, including all taxes, is shown below.

9. GENERAL PROVISIONS

9.1. Information and Acceptance

The BUYER accepts, declares, and undertakes that they have read the preliminary information regarding the basic qualities, sales price, payment method, and delivery of the product subject to the contract on the SELLER's website, have obtained information, and have given the necessary confirmation electronically.

9.2. Delivery Time

Each product subject to the contract shall be delivered within the period specified in the preliminary information section on the website, depending on the distance of the BUYER's place of residence, provided that it does not exceed the legal period of 30 days.

10. RIGHT OF WITHDRAWAL

If the distance contract relates to the sale of goods, the BUYER may exercise their right of withdrawal by rejecting the goods without giving any reason, provided that they notify the SELLER within 14 days from the date of delivery of the product to themselves or to the person/organization at the address indicated by them.

11. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

Products prepared in line with the BUYER's request or explicit personal needs, such as underwear bottom pieces, make-up materials, and single-use products, are excluded from the scope of the right of withdrawal.

12. DEFAULT AND ITS LEGAL CONSEQUENCES

The BUYER accepts, declares, and undertakes that if they default on their credit card payments, they will pay interest within the framework of the credit card agreement with the cardholder bank and will be responsible to the bank.

13. AUTHORIZED COURT

In disputes arising from this agreement, complaints and objections shall be made to the consumer arbitration committee or consumer court at the consumer's place of residence or where the consumer transaction took place.

14. EFFECTIVENESS

By making the payment for the order placed through the Site, the BUYER is deemed to have accepted all terms of this agreement.
